These games will be broadcast commercial free, and will feature exclusive behind-the-scenes access to the Oilers dressing room, the players and the coaches.

PERMISSIONS REGARDING EXHIBITION OF MOLSON CANADIAN OILERS
2007/08 PAY PER VIEW GAMES

This is to confirm that you are authorized to exhibit the 2007/2008 Pay Per View games of the Edmonton Oilers (the “Games”) distributed through your digital cable or satellite carrier to your patrons in your establishment described in your Molson Canadian Oilers 2007/2008 Pay Per View Application Form.

No right to exhibit the Games at any other location, or to record by any means and exhibit the Games otherwise than on a live basis is provided and you agree that you shall restrict the exhibition of the Games to this location on a live basis. Any breach of this restriction shall be grounds for us to rescind the authorization hereby given, retain all monies paid, and to seek damages against you for breach of your agreement.

You agree that you shall not engage in any activity or promotion, which associates any third party with the Games without our expressed prior written consent.

Unless expressly granted, you shall not obtain any right, title or interest in the trade names or trademarks of Edmonton Investors Group Ltd. (“EIG”) (including the Oilers), the NHL, or any affiliate of such, nor shall this Application give you the right to use, refer to or incorporate the corporate and team name, trade names, trademarks, logos, official designation or other intellectual property of EIG (including the Oilers name and logos) or the NHL in any way, including, without limiting the generality of the foregoing, in any activity or promotion relating to the Games.

You have requested that we arrange for you to receive the Games through the digital cable or satellite provider you have indicated in the Application. You agree that our sole responsibility with respect to arranging for the transmission of the Games to you is to process your order and pass it along to the distributor. In the event, for any reason whatsoever including the error or negligence of ourselves or the distributor, the transmission of the Game(s) is not received at your location, neither Breakaway PPV Corporation, the distributor or EIG, their respective affiliates or agents, shall be liable to you or to any third party for any direct, indirect, special, or consequential damages, including loss of profits and/or loss of business opportunities, and your exclusive remedy shall be to receive from us, payment for actual and direct damages to a maximum amount equal to that portion of the fees paid by you to us as described below in respect of any Game not received in its entirety.

In consideration for Breakaway PPV Corporation granting to you the right to exhibit the Games you agree to pay to us by the dates indicated the amounts mentioned in that part of the Application you have selected as indicating your choice of payment plans, with payment clearing no later than forty-eight (48) hours prior to the first Game ordered. Not until we have received the required monies and a signed copy of your Application does the authorization to exhibit the Games come into effect. Any failure of payment shall result in the immediate cancellation of this authorization.

In the event that you have not submitted full payment for the Games, or if any payment provided by you is returned to EIG, or if your authorization to debit your account is revoked prior to all payments being made pursuant to the Application, you hereby authorize EIG to debit the credit card you have provided for the entire outstanding amount owed to EIG pursuant to this Agreement. You also hereby authorize EIG to debit the credit card you have provided with a $25.00 service charge for each dishonoured payment as it occurs. You understand and agree that you are still responsible for the full payment for the Games to be paid according to the payment plan, and that EIG will not refund any money to you for any Game purchased under this Application.

By completing the Application, you hereby grant to EIG consent to use the personal information provided in the Application to provide you with the products and services you have requested, for the continued administration and maintenance of your account and your on-going relationship with EIG in accordance with the Privacy Statement found at http://edmontonoilers.com/.
